A Wattsburg man charged with opening fire at a state trooper will face a jury. Andy Allen is charged with aggravated assault on law enforcement. This, after troopers say, Allen fired several shots at the officer after troopers were called for shots fired inside a home in August.
50-year-old Andy Allen appearing for his preliminary hearing this morning; the Judge binding over all charges to trial. A Pennsylvania State Trooper taking the stand, testifying Allen fired at least two gunshots at him.
The Trooper says after they were able to put Allen in custody, he admitted to shooting the gun, telling the Trooper he was "shooting at you from the back of my barn.” This incident happened in the 9000 block of Haskhill road around three in the morning on August 29th.
A criminal investigator for Pennsylvania State Police also testifying after interviewing Allen about what lead up to police being called to the house that night. Allen told the trooper his boyfriend and family members moved in with him and tension grew after he caught the family members talking about him on a video recording.
The night of the 29th, police report a fight broke out between Allen and his boyfriend. Allen admitting to firing at least three shots in the home. However, through testimony, Allen said several times that he did not know it was a police officer he was shooting at. The defense arguing that in order to be charged with Aggravated Assault on a Law Enforcement Officer, Allen had to know it was a trooper.
