Man who spit in officer's face up for parole

An Erie man whose arrest led to charges against an Erie Police Officer learns his fate in court.  Patrick Gehrlein is sentenced to spend 23 months behind bars for terroristic threats and resisting arrest.

Gehrlein, 33 at the time, was handcuffed during a domestic dispute call on Oct. 10 when officer Justin W. Griffith, 35, kicked Gehrlein in the face.  Erie Police Officer Justin Griffith was charged with simple assault after being accused of kicking Gehrlein after he said he had AIDS and began spitting at the officers.  Griffith was found not guilty of those charges in a trial in June. 

Gehrlein suffered facial fractures around the eye and cheek during the incident.

Gehrlein received credit for time he's served in prison and is eligible for parole.
