Ernest Leclair appears in court today

Ernest Leclair is heading to trial on the charge of tampering with evidence after police charged him with hiding the gun his son, Christopher Leclair, allegedly used to kill his wife.

75 year old Ernest Leclair leaves his preliminary hearing today.  He is charged with moving a 38 caliber handgun from the ceiling tiles in Christopher Leclair's basement to underneath a drawer below a bed in Christopher and Karen Leclair's Albion home.  

Christopher Leclair is charged with shooting his wife, Karen, and dumping her body overboard in June.  Karen's body was recovered off Lake Erie shores in Dunkird, New York on the Fourth of July.

In the hearing today, a trooper from Pennsylvania State Police testifying they charged Ernest with tampering with evidence because of several phone conversations and an in-person visit between Christopher and Ernest after Christopher was put in Erie County Prison on those murder charges.  

The trooper also saying Christopher asked his father to make the gun 'vanish' and make sure State Police did not find the gun.  Also, the trooper testified that Ernest admitted to moving the gun in an interview, however; Ernest's Attorney, Gene Placidi says the Commonwealth did not meet the Burden of Proof for the Tampering with Evidence charge and there was no intent there.

"If there was intent to make the gun unavailable to the police," says Placidi, "the gun would have disappeared, number one. Number two is; he was asked to leave the house... he wasn't going back into the house. If he wanted to do anything illegal or improper with the gun; he would've taken the gun when he left the house. He was, for all impractical... purposes, removed from the house by the Power of Attorney and he never went back into the house." 

Placidi also says they plan to file a habeus corpus petition on the case, and that he can't answer why Ernest moved the gun, but says he had no intention of ever destroying the gun or removing it.

When Ernest Leclair was asked if he wanted to say anything, his reply simply, was 'no'.
