A North East family is suing the school district, school board members and the driver of the car that hit and killed their 11-year-old son February 9th.
The Wion family filed a lawsuit against the Wattsburg School District and Hunter Rodland late last week.
Rodland was the driver of the Jeep that swerved to avoid hitting a Wattsburg-area school bus -- but struck and killed 11-year-old Noah Wion.
The district attorney's office charging Rodland with summary offenses after an accident report found he was not able to stop because of winter conditions on Station Road.
The judge's office says Rodland pled guilty to those charges Tuesday and paid his fines.
The family's lawsuit claiming the bus route was set up on a dangerous road -- to save time and money -- jeopardizing student safety.
The lawsuit also claims the bus driver did not follow proper safety protocols and was "not paying attention."
