Trial begins in homicide by vehicle case

Kevin Deck is on trial for third-degree murder, homicide by vehicle while driving under the influence, aggravated assault, involuntary manslaughter and driving while under the influence. 

Opening statements began this morning with the assistant district attorney telling the jurors Deck is charged with third-degree murder because he maliciously killed Jorge Toledo.  Deck's defense attorney telling the jurors he will not be disputing the facts in this case and that Deck is guilty of many of the charges he is facing, but he told the jurors Deck is not a murderer.

This, after Deck is accused of running a red light at the intersection of East 21st and Ash streets in November of last year.  That accident killing Toledo on scene and sending the driver of the other car to the hospital for dozens of surgeries, eventually leading to the loss of her left leg.

Testimony will continue this afternoon.
