Trial for 4 men accused of murder postponed

ERIE, Pa. -- The four men accused of killing Shakur Franklin will have to wait longer to head to trial facing murder charges.

On Monday, the judge postponed the trial of Stephen Russell, Demond Mitchell, Keshawn McLaurin and Jahaun Jones.

The defense appealed the pre-trial ruling which allowed the state to go through with the trial solely on hearsay testimony.

In the preliminary hearing for the four defendants, only one detective testified but no witnesses took the stand.

The defense asked for the Superior Court to step in. However, since the appeal is still pending in higher court, the trial is being postponed.

No new trial date has been set.

Franklin was shot and killed at 230 W. 29th St., on July 24, 2015 during a house party.

Darion Eady was found guilty of third-degree murder in the shooting death of Elijah Jackson, who was shot and killed at the same party.

Eady's attorney said he filed a motion earlier this month for a new trial. Attorney Bruce Sandmeyer said he filed the motion because a family friend of Eady overheard a juror outside the courtroom after the trial make comments about knowing Jackson. 

A judge is expected to review the motion this week.
