PA Supreme Court Denies Governor’s Request for Reconsideration of Act 13: Another Victory for Local Communities
The Pennsylvania Supreme Court today denied Governor Corbett’s request for reconsideration of the December 19, 2013 decision in Robinson Township v. Commonwealth, known as the Act 13 case.

The Sierra Club Pennsylvania Chapter believes that the Pennsylvania Supreme Court correctly judged that Act 13 did not provide adequate environmental protection for the residents of Pennsylvania.

The December 19, 2013 opinion, authored by the Chief Justice Castille, stated that “several core provisions of Act 13 violate the Commonwealth’s duties as trustee of Pennsylvania’s public natural resources under the Environmental Rights Amendment,” which is Article 1, Section 27 of the Pennsylvania Constitution.

The denial of his request for reconsideration today comes in the wake of Corbett’s expressed desire to exploit natural gas under state owned land.
