Eugene Metzger is heading to trial on homicide-by-motor-vehicle charges

Police say he turned into the path of a motorcycle in the 2100 block of East 38th Street last August.

The driver of the motorcycle, Jamie Wilt, was injured in the crash.

His girlfriend, Magen Porter, was killed.

After that accident, police talked to Metzger both at the scene of the crime and later at the police station.

Today Metzger asked a judge to throw out those conversations, claiming that the police did not read him his Miranda Rights.

The District Attorney´┐Żs office has 10 days to respond.
