Four men accused in an April shooting will be released from jail after the victim failed to appear for Monday’s court hearing.
Luis Lopez, Melquan Barnett, Tony Hollingsworth Jr. and Curtis Henderson Jr. will have all charges dropped in the shooting of a 22-year-old man on April 21 on Erie’s east side.
Police said the men fired shots into a home in the 300 block of Wallace Street, striking the victim in the back.
Because the victim didn’t show up for court, there wasn’t enough evidence to move forward with the case.
“It does happen from time to time,” said James Pitonyak, Hollingsowrth’s attorney, about the victim not appearing in court. “Sometimes witnesses don’t appear for different reasons, perhaps they weren’t really telling the truth, which is what our defense would have been in this case.”
