Defense argues tainted marijuana might be to blame in fatal stabbing

The prosecution and defense dispute over an additional request in an Erie County homicide case.

Investigators say 24-year-old James Gilbert fatally stabbed his girlfriend, 20-year-old Marinda Matasowski then stabbed himself in the chest last August.  

In a pre-trial motion, the defense wants additional tests run on the marijuana Gilbert allegedly used before the stabbing, claiming Gilbert experienced unusual symptoms.

The District Attorney Jack Daneri says State Police have already tested the marijuana and no other drugs were found.

A hearing is scheduled for March 20th.
