Darion Eady was convicted of murder in February, but he could return to the courtroom soon.
Eady was found guilty of third degree murder in the 2015 shooting of Elijah Jackson, 16.
Eady’s attorney, Bruce Sandmeyer, says he filed the motion because a family friend of Eady allegedly overheard a juror outside the courtroom after the trial make comments about knowing Jackson.
The evidentiary hearing for the murder charges is set to happen at 9:30a.m. in front of Judge William Cunningham.
