Should items found while chasing a subject be allowed at trial? Just one question in the pre-trial motions of robbery and resisting arrest suspect Rather Freeman.
An Erie Police Officer testifying that following a traffic stop, Freeman got out of a car, said, ‘Bye,’ to the officer, and took off running.
He was found in a home two days later where he tried to run away from officers again. A number of items were found in that home, including a gun.
The defense maintains the search wasn’t legal because no search warrant was obtained.
Freeman declined a guilty plea so the case is moving to court.
