The second person in Erie County ever charged with drug delivery resulting in death will head to trial.
Henderson is accused of providing heroin, fentanyl and cocaine to a 56-year-old man who was later found unresponsive in a Millcreek home in June.
The only other time a person was charged with drug delivery resulting in death was a case in the Erie County Prison. The prosecution saying the charge is equivalent to third-degree murder.
Officials tell us the judge will reportedly have his decision by the end of the day.
