Suspect accused of stealing items from a home after the resident’s death heads to trial

A fourth suspect charged in stealing from a home hours after the residents died is heading to trial.

Today, Marlaina Payne waived her right to a preliminary hearing in Erie County Court.  Police say she was involved in a burglary that took place at a home at 504 East 30th Street in November.  Three people were arrested originally.

Investigators charge they stole televisions, credit cards, and a gun from the home just hours after two men drowned in floodwaters that caused a basement wall to collapse.
